LHC suspends denotification of 43 PTI MNAs

The Lahore High Court has suspended the Election Commission’s order to de-notify 43 members of the National Assembly (MNAs) of the Pakistan Tehreek-e-Insaf (PTI).

Lahore High Court Justice Shahid Kareem heard the petition against accepting the resignation of 43 former members of the National Assembly including PTI MNA Yaz Fatiana.

Barrister Ali Zafar, the lawyer of the PTI members, said that the legal requirements for accepting the resignation were not fulfilled.

Justice Shahid Karim inquired that what legal requirements were not fulfilled?

Barrister Ali Zafar said that the speaker did not conduct an inquiry under the constitution before accepting the resignation, the members of the assembly did not appear before the speaker to accept the resignation, the speaker cannot accept the resignation without hearing the members.

The court suspended the Election Commission’s order to de-notify 43 assembly members and also suspended the by-elections in 43 constituencies until further notice.

The court issued a notice to the Election Commission and other parties and sought their response.
