CJP forms seven SC benches for week starting Jan 18

ISLAMABAD: Seven benches of the Supreme Court, formed by Chief Justice of Pakistan (CJP) Justice Anwar Zaheer Jamali, would take up the cases during next week starting from Monday, January 18, 2016.

The bench one headed by Chief Justice Anwar Zaheer Jamali and comprise of Justice Sh. Azmat Saeed and Justice Khilji Arif Hussain would hear cases including election petitions of Chaudhry Muhammad Ilyas against Ch. Abid Raza, Muhammd Yaqub Nadeem Sethi against Muhammad Ilyas Khan, Usman Dar v. Khawaja Muhammad Asif, Mst. Shamuna Badshah Qaisrani v. Khawaja Muhammad Daud Sulemani, Pakistan Medical & Dental Council (PMDC) thr. its President v. Government of Pakistan, M/o National Health Services, Regulation & Coordination, Islamabad thr its Secretary & others, Review on behalf of Multi Professional Cooperative Housing Society v. CDA Under Art. 184/Enforcement of Fundamental Rights / Human Rights, election matter of Muhammad Khan v. Obaid Ullah Jan Babat, Review on behalf of Federation of Pakistan through Secretary, M/o Finance over Action Against Distribution of Development Funds by Ex-Prime Minister Raja Parvez Ashraf, election matters of Shahbaz Ahmad v. Muhammad Auan Abbas Khan and Dewan Ashiq Hussain Bokhari v. Rana Muhammad Qasim Noon.

The bench two comprising Justice Mian Saqib Nisar, Justice Iqbal Hameedur Rahman and Justice Tariq Pervez would hear cases including National Assembly election matter of Illahi Bukhsh Soomro v. Aijaz Hussain Jhakrani and Public Interest Law Association through its President Aftab Nabi v. Federation of Pakistan and others Regarding disbursement of Supreme Court and High Court funds without any interference of Executive and filling up of vacancies of Superior Courts.

Similarly, the bench three comprised of Justice Asif Saeed Khan Khosa, Justice Mushir Alam and Justice Sardar Tariq Masood while fourth bench consist of Justice Amir Hani Muslim and Justice Umar Ata Bandial.

The fifth bench comprised of Justice Ejaz Afzal Khan and Justice Faisal Arab would hear case including matter regarding  Publishing/printing incorrect version of Section 23 of Contract Act, 1872 in the Book titled “The Contract Act, 1872, 2nd Edition/2011” by M. Mahmood, Advocate, matter regarding Miss Printing of Section 7(1)(e) and Section 7(4)(d) & (e) of the Patent Ordinance, 2000 in the Book Titled “MANUAL OF INTELLECTUAL PROPERTY LAWS” (Accession No.76353) compiled by Khurram Shehzad Chughtai and Majid Bashir, Published by Manzoor Law Book House, miscellaneous matters on  Section 2(K)(i) of Punjab Consumer Protection Act, 2005 in the Books titled “Consumer Protection Laws in Pakistan” authored by S.A. Abid Advocate High Court published by Key Law Reports (Edition 2011/2012) and Manual of Consumer Protection Laws by Raja Nadeem Haider, ASC Published  by Punjab Law House(Edition 2009), matter regarding Wrong version of Section 420 Published in the Book Titled “The Code of Criminal Procedure, 1898” by M. Mahmood, Advocate (Edition , 2005) in Schedule II of which Section 420 has been Shown as BAILABLE, National Assembly election matter of Khalid Hussain Magsi v. Mir Abdul Rahim Rind regarding validity of verification of ballot papers by NADRA, suo-moto action regarding number of deaths due to Pneumonia  & Hepatitis and Al-Jihad Trust through Raeesul Mujahideen Habib-ul-Wahabul Khairi, etc. v. Federation of Pakistan through Secy. M/o Kashmir Affairs & Northern Areas.

The sixth bench comprise of Justice Dost Muhammad Khan and Justice Manzoor Ahmed Malik while the seventh bench comprise of Justice Qazi Faez Isa and Justice Maqbool Baqar.

During the next week, the benches will also take up different  criminal, civil cases and suo moto notices, NAB/Ehtesaab cases.

According to case lists, no adjournment on any ground will be granted and no application for adjournment through fax will be placed before the Court. Furthermore, if the counsel is unable to appear for any reason, the  Advocate-on-Record will be required to argue the case.
